**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 119 dated 31.7.2017 registered at Police Station Sadar Fazilka under Sections 354-B IPC and Section 8 of Protection of Children from Sexual Offences Act. Counsel for the petitioner contends that the petitioner is 60 years old and is unmarried and a labourer and he is in custody since 30.7.2017 and the victim and her mother, grandmother and brother have already been examined and the case was registered as the complainant have an eye on his plot.

The allegations against the petitioner are that he led the child inside the house and removed his clothes and of the child. At that moment the brother of the victim entered the room who was heckled. The child ran back and told the story to the family. The daughter-in-law of the complainant came and found the petitioner and the child without clothes. Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate with a rider that he would not contact the complainant or her family.
