(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.174 dated 17.12.2019 registered under Sections 363, 366, 120B IPC and Sections 3 and 4 of POCSO Act, 2012 at Police Station Sadar Batala, District Batala to the petitioner, who is in custody since 19.12.2019. Learned counsel appearing on behalf of the petitioner would contend that there is an allegation in the FIR that son of the petitioner has enticed away minor daughter of the complainant aged 17 1⁄2 years in full connivance with the petitioner. It is also argued that the matter has been investigated and the challan has been presented, while submitting that she has no knowledge about the whereabouts of her son or daughter of the complainant.

Learned counsel appearing on behalf of the respondent-State would submit that the petitioner herein was rightly arrested under the said FIR, while stating that at present moment, there is no knowledge with regard to son of the petitioner or of the daughter of the complainant, PANKAJ KUMAR 2020.02.27 11:19 I attest to the accuracy and integrity of this document

CRM-M No.7556 of 2020 -2therefore, custodial interrogation of the petitioner would be required. I have heard learned counsel for the parties. In view of the fact that the matter has been investigated and complainant has suffered statement and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
