State of Haryana and others .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Sanjay Vashisth,Advocate for the petitioners Mr.Gaurav Dhir,DAG Haryana Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail to accused Narender and Nikku @ Virender in FIR No.237 dated 19.6.2015 under Sections 148,149, 323,324 IPC (Subsequently added Sections 325,506 IPC and 25/54/59 of the Arms Act)PS Pataudi,Distt.Gurgaon. In the occurrence on 18.6.2015 there is a version and cross version recorded vide two separate FIRs. The present case is the first version.

As per allegations both the present petitioners are attributed lathi blows on the person of injured Mahipal,Ramgopal and Khushi Ram.

CRM-M 1165/2016 arm, which has resulted into fracture and opined to be grievous in nature, has been attributed to Sunil @ Sanju non-applicant co-accused who has since been granted anticipatory bail by this Court. Injuries attributed to present accused are opined to be simple in nature and for the allegations to be made non-bailable offence under Section 506 IPC has been falsely added. It is further submitted that petitioners have since joined investigation and their custodial interrogation is no longer required.

Learned State counsel on instructions from ASI Jaswant Singh does not dispute the aforesaid factual position and admits that rest of the co-accused have since been granted anticipatory bail. He also concedes that petitioners have joined investigation and as such nothing is to be recovered.

In view of the aforesaid circumstances, interim protection/bail granted vide order dated 22.1.2016 is made absolute. Disposed of.
