**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 25 dated 25.2.2015 under Sections 420/406 IPC registered at Police Station Sadar Jagadhri, District Yamuna Nagar. Notice of motion was issued and interim protection was granted.

Learned counsel for the petitioner submits that during the pendency of present petition, matter has been amicably settled between the parties. He further submits that based on the compromise, petitioner has filed a petition seeking quashing of this very FIR on the basis of compromise. He prays for allowing the present petition.

Criminal Misc. No. M-10688 of 2015 Learned counsel for the State, on instructions from ASI Lokesh Kumar, submits that no such compromise has been placed by the petitioner either before the investigating agency or before this Court. However, he is not in a position to deny the factum of compromise arrived at between the parties. Be that as it may, custodial interrogation of the petitioner would not be required. In this view of the matter, instant petition is allowed and order dated 2.11.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Sections 438 (2) Cr.P.C. Disposed of, accordingly.
