(Oral) The petitioner has approached this Court seeking directions to the respondents to treat the petitioner as deemed to have been promoted to the promotional posts with effect from the date junior to him namely Sh. Jagdish Chander was promoted as such and all consequential benefits may kindly be allowed to him. Learned counsel appearing on behalf of the petitioner contends that he has no further instructions from the petitioner. Notice was issued to the petitioner, however, as per the report, he was not residing at the current address. Hence, the whereabouts of the petitioner are not traceable at this juncture. The petitioner had joined the services as 'Clerk' in 1962.
CWP-5594-2002 (O&M) -2Hence, the petitioner is now more than 81 years of age and may not have any further subsisting interest in pursuing the present writ petition. Dismissed for non-prosecution.
Liberty is, however, granted to the petitioner and/or the LRS to seek revival of the present writ petition, if any grievance still survives.
All the pending miscellaneous application(s), if any, are also disposed of.
