The present petition has been filed under Section 482 Cr.P.C. praying for issuance of direction to the respondents to register FIR against the accused persons regarding the cognizable offence committed by them in pursuance of complaint dated 10.11.2023 (Annexure P-4), reminder dated 23.01.2024 (Annexure P-5) and legal notice dated 25.01.2024 (Annexure P-6) given by the petitioner wherein it is alleged that fraud and forgery has been committed by the accused persons upon the deceased father of the petitioner, in view of judgment passed by the Hon'ble Supreme Court in Lalita Kumari Vs. State of Uttar Pradesh 2014 (1) SCC (Cri.) 524. 2.

Learned counsel appearing for the petitioner inter alia contends that father of the petitioner was owner of car bearing No.PB11CL6036 and after his death, son of brother of the petitioner namely Paramjot Singh son of Harjit Singh in collusion with the notary public and others, fabricated an affidavit dated 31.01.2024 and other papers.     the accused persons usurped the car of father of the petitioner on which the petitioner has a lawful right. In this regard, petitioner has given a complaint dated 10.11.2023 (Annexure P-4) to respondent No.3 as well as reminder dated 23.01.2024 (Annexure P-5) but no action has been taken thereon. It is further submitted that the petitioner will be satisfied if the complaint dated 10.11.2023 as well as the subsequent reminder and legal notice is decided by the official respondents in a time bound manner.

On the asking of the Court, Mr. Subhash Godara, Addl. A.G., Punjab, who is present in Court, accepts notice for the respondent-State and submits that the official respondents will look into the matter and decide the complaint of the petitioner as expeditiously as possible. 5.

Without going into the merits of the case, I dispose of the present petition with a direction to the official respondent No.3 to consider the complaint dated 10.11.2023 (Annexure P-4) and subsequent reminder/legal notice of the petitioner and decide the same within a period of four weeks from the date of receipt copy of this order.
