Mr. SP Thukral, Advocate for the petitioner.

Mr. HS Garcha, DAG Punjab along with Mr. Ram Parkash, SDO, Department of Shah Nehar Head Works Division, Talwara (Irrigation).

* * * * The petitioner filed this writ petition claiming gratuity in the sum of Rs.1,49,688/- and other retiral benefits. It is not disputed as of now that the amount of gratuity had been released in the year, 2001 to the petitioner under the orders of the High Court. No retiral benefits remained to be paid. Counsel, however, submits that some amount on account of Employees Provident Fund Contribution remains to be paid. However, the said amount is not the subject matter of the writ petition. It is left open to the petitioner to approach the Provident Fund Commissioner to seek relief in that behalf. We hope and expect that State of Punjab will help the petitioner in getting the provident fund released, if required. Since the payment of other retiral benefits has been made, this renders the writ petition infructuous and it is disposed of accordingly with the above observations.
