(Oral) Prayer in the present petition is for grant of ancitipatory bail to the petitioner in case FIR No.0005 dated 12.02.2020 (Annexure P-1), under Sections 406, 498-A of Indian Penal Code, registered at Police Station Woman, Police Commissionerate, Amritsar.
Vide order dated 08.03.2021, while granting interim protection, the petitioner was directed to join the investigation. Learned counsel for the petitioner has submitted that in pursuance to the order dated 08.03.2021, the petitioner has joined the investigation. He submits that the matter was referred to the Mediation and Conciliation Centre of this Court, however, the dispute could not be resolved.
Learned counsel for the complainant has submitted that the
-2CRM-M-10646-2021 parties though appeared before the Mediation and Conciliation Centre of this Court but the same remained unsuccessful due to the non-cooperating conduct of the petitioner.
Learned State counsel, on instructions from ASI Tejinderpal Singh, has affirmed the fact that the petitioner has joined the investigation. In the facts and circumstances, this Court finds that the interim order dated 08.03.2021 deserves to be confirmed. As no settlement has taken place between the parties, so the matter requires to be decided on merits by the learned trial Court.
In view of the above, interim order dated 08.03.2021 is made absolute subject to compliance of conditions as envisaged under Section 438 (2) Cr.P.C.
Petition stands allowed.
