**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner, by way of instant petition, under Section 482 Cr.P.C., seeks quashing of impugned order dated 20.7.2012 (Annexure P-6) passed by the learned JMIC, Gurgaon and also order dated 20.3.2015 (Annexure P-10) passed by the learned Additional Sessions Judge, Gurgaon, whereby the petitioner was declared as proclaimed person.
Learned counsel for the petitioner submits that petitioner was inside the jail in some other case, because of which he could not appear before the learned court on the relevant dates of hearing. Thus, non appearance of the petitioner was not intentional, but because of bonafide reasons. He further submits that petitioner is not running from law and is ready and willing to surrender before the learned trial court, which may be directed to consider the bail application of the petitioner.

CRM-M-10776 of 2015 Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present petition is disposed of with a direction to the petitioner to surrender before the learned trial court within a period of one week from today. The learned trial court is also directed to consider the bail application of the petitioner sympathetically, coupled with the observations made hereinabove, and decide the same, at an early date. With the abovesaid observations made and directions issued, present petition stands disposed of.
