(ORAL) Today, reply on behalf of respondents No.3 and 4 has been filed, which is taken on record. As per the same it has been claimed that the pending arrears of salary as claimed by the petitioner for the period from April 2009 to November, 2009 have been paid vide Cheque dated 24th of April, 2023 after having been put to notice by this Court. Counsel for the petitioner submits that though the arrears have been released yet the petitioner would be entitled for interest on delayed payment of such arrears as the same was withheld without any reason by the respondents for 14 long years.
In the considered opinion of this Court once the respondents have admitted that the arrears of salary were payable to the petitioner and the same ought to have been paid way back in the year 2009 the fact that DEEPAK KUMAR 2023.04.26 17:29 I attest to the accuracy and integrity of this document
CWP-3639-2023 -22023:PHHC:058943 the petitioner has been constrained to approach this Court to claim arrears of salary cannot be taken lightly.
