RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.45 dated 13.07.2015 (Annexure P-1) registered under Sections 326, 325, 323, 341, 427, 506, 148 and 149 IPC at Police Station Rangar Nangal, District Batala, on the basis of compromise dated 10.03.2018 (Annexure P-2).
Pursuant to order dated 20.03.2018 of this Court, the parties appeared before the trial Court/Illaqa Magistrate on 02.05.2018 to get their statements recorded. Learned Sub Divisional Judicial Magistrate, Batala, has submitted her report vide letter bearing No.695 dated 18.05.2018 duly forwarded by learned District and Sessions Judge, Gurdaspur vide Endst. No.10311/RKT dated 19.05.2018.
According to the report, learned Sub Divisional Judicial Magistrate, Batala is satisfied that compromise entered into between the parties is genuine, voluntary, without any coercion or undue influence from Ravinder Singh 2018.07.05 14:22 I attest to the accuracy and authenticity of this document any side.
Considering the report of learned Sub Divisional Judicial
-2CRM-M-11715 of 2018 Magistrate, Batala, dated 18.05.2018 and the fact that the compromise will bring peace and harmony in relations between the parties, FIR No.45 dated 13.07.2015 (Annexure P-1) registered under Sections 326, 325, 323, 341, 427, 506, 148 and 149 IPC at Police Station Rangar Nangal, District Batala is hereby quashed, subject to payment of costs of `10,000/-, out of which `6,000/- shall be deposited with the Punjab State Legal Services Authority and `4,000/- with the Punjab and Haryana High Court Lawyers' Welfare Fund.
Petition is disposed of accordingly.
