IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-9429-2023 Decided on : 13.11.2025 Mewa Singh . . . Petitioner(s)

Versus

State of Punjab and another . . . Respondent(s)

CORAM:

HON'BLE MR. JUSTICE SANJAY VASHISTH PRESENT: Mr. J.S. SinglaChauhan, Advocate for the petitioner(s).

Mr. Neeraj Madaan, Sr. DAG, Punjab assisted by ASI Sukhjant Singh.

**** SANJAY VASHISTH , J. (Oral) 1.

After hearing learned counsel for the petitioner, on 28.10.2025, following order was passed by this Court:- "

In the instant quashing petition, on 22.02.2023 following order was passed:

"Petitioner is seeking to quash FIR No. 30 dated 27.04.2010 under Sections 324, 336, 323, 382, 148, 149 IPC and under Sections 25/27 of Arms Act (later on offence enhanded under Section 326 IPC), registered at Police Station Dayalpura, District Bathinda.

Learned counsel for the petitioner contends that the petitioner was found innocent during the course of enquiry and Annexure P-2 is the report in this regard. Although, other persons were arraigned as accused but as per his instructions, the challan has not been presented against any of the persons till date, though, the FIR was registered wayback on 27.04.2010. Notice of motion.

Ms. Ruchika Sabherwal, DAG Punjab accepts notice on behalf of the State and seeks adjournment to get instructions and submit the reply.

Adjourned to 03.05.2023."

Despite the case being pending for the last more than a period of two years and FIR was registered 15 years back, till date, no plausible explanation has come forward from the State as to why the Final Report has not been submitted to the concerned Court.

One last opportunity is granted, failing which, Court would be constrained to call for the presence of Sr. Superintendent of Police, Bathinda before this Court.

Let the copy of this order be sent to the office of Sr. Superintendent of Police, Bathinda.

Adjourned to 13.11.2025.

To be shown in the urgent list."
