(Oral) Prayer in the present petition filed under Section 438 of Cr.P.C. is for grant of anticipatory bail to the petitioners in case FIR No.129 dated 06.11.2018 registered under Sections 353, 186 and 332 (added later on) IPC at Police Station Cantt. Bathinda, District Bathinda. Learned counsel for the petitioners has argued that the only allegation against the petitioners is of pushing and kicking. Learned Deputy Advocate General on instructions from ASI Binder Singh states that this is an incomplete statement. The real facts are that the petitioners alongwith their son and daughter-in-law went to the school of their grandson and manhandled the teacher who was on duty. Counsel for the petitioners states that the petitioners are old grandparents of the child. Therefore, father of the child i.e. son of the petitioners namely Baldev Singh would surrender but these old people should not be subjected to custodial interrogation. Learned Deputy Advocate General has accepted these facts. In these circumstances, let the petitioners appear before the IO on 30.03.2019 alongwith their son Baldev Singh. On their so appearing Baldev Singh would be taken into custody and the petitioners would be released subject to conditions envisaged in Section 438(2) Cr.P.C. Since the main case has been decided, the pending Criminal Misc. Application, if any, also stands disposed of.
