Instant petition has been filed under Article 226/227 of the Constitution of India for issuance of appropriate writ in the nature of Habeas Corpus for the search and release of Detenue Appu, brother of petitioner, and directing the official respondents to produce the detenue before this Court.

This Court vide order, dated 10.02.2025 had appointed the Warrant Officer with a roving writ and he was directed to submit its report. Report of the Warrant Officer has been placed on record. The same has been perused.

As per the report, the Warrant Officer accompanied with the petitioner raided the place where it was found that the detenue was required in GD No.4, dated 10.02.2025, under 137(2) of Bharatiya Nyaya Sanhita, MEENU 2025.02.14 09:54 I attest to the accuracy and integrity of this document
CRWP-1436-2025 -22023 and Sections 64(1) & 06 of POCSO Act. It is further submitted that presently he is behind bars.

Learned counsel for the petitioner though has raised the submission that the petitioner was illegally arrested, however, keeping in the view the scope of the petition, the same is disposed of with liberty to the petitioner to avail her legal remedies as available to her in accordance with law.
