Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.184 dated 19.07.2014 under Sections 192, 469, 471, 472, 503 and 120-B IPC, Sections 4/5 of the Explosive Act and Section 66-F of the Information Technology Act registered at Police Station City Kotwali, District Faridkot. Notice of motion.

On the asking of the Court, Mr.S.S.Chandumajra, Deputy Advocate General, Punjab accepts notice on behalf of the respondent-State.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The main allegation against the present petitioner is that he tried to frame Satwant Singh with forged ID of Karachi which fact VINEET GULATI 2015.01.20 16:59 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-1084 of 2015 -2was corroborated from the recovery of computer. Learned State counsel, at the time of arguments, argued that no explosive has been recovered from the petitioner. The petitioner is in custody since 21.07.2014. He is not required for investigation or interrogation purposes nor anything is to be recovered from him. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case.

Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merit of the case, the present petition is accepted and the petitioner is ordered to be released on regular bail on furnishing bail bonds in the sum of `40,000/- with one surety in the like amount to the satisfaction of the learned trial Court/Duty Court, Faridkot.
