The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.21 dated 9.2.2018 registered for the offences under Sections 406 and 420 IPC at Police Station Chabbewal, District Hoshiarpur.

Notice of motion has been issued in this case. Mr. Karanbir Singh, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned State and have gone through the record. As per the allegations in the FIR, Lovedeep Singh talked to the complainants-Mandeep Singh and Jaswinder Singh that he and his father Prem Kumar are jointly running a Travel Agency and had sent lot of people HARPAL SINGH PARMAR 2018.10.05 14:55 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-11772 of 2018 [2] abroad and asked them to meet his father Prem Kumar. As per the allegations, Prem Kumar demanded `3 Lakhs each in advance and `2.50 Lakhs each on reaching Macau after getting job. As per the allegations, they paid `6 Lakhs and the complainants were sent to Macau, but the obligation that son of the petitioner will arrange job was not fulfilled. The petitioner has already joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 20.4.2018 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. October 04, 2018.
