(Oral) The challenge in the present revision petition is to the order dated 13.02.2020 whereby the Trial Court directed the petitioner to restore the electricity supply to the shop of the respondents herein. Learned counsel for the petitioner would contend that the electricity supply qua the shop of the respondents has been disconnected by the Electricity Department and the petitioner is no one to restore the electricity connection.
It is further the contention that the petitioner would have no objection if the respondents move an application for restoration of the electricity connection whether directly from the meter installed in the premises of the petitioner or by installing a sub meter in his own premises and after clearing all the arrears if any found due. Learned counsel for the respondents states that he has no objection and would be satisfied if an order is passed that if any application is filed by the respondents for restoration of the electricity connection to the shop the same would be dealt with by the Electricity Department expeditiously and the petitioner should fully cooperate in getting the electricity connection restored. CR No.1231 of 2020 2023:PHHC:040836 -2states that the respondents would bear all the expenses for installation of the sub meter and would continue to pay the electricity consumption charges qua their shop in future also.
Heard.
In view of the statements made by learned counsel for the parties, the present revision petition is disposed off with a direction that the respondents shall file an application with the Electricity Department for restoration of the electricity connection to the shop within 10 days from today. The Electricity Department shall consider the application on merits and intimate the respondents if there are any arrears which shall thereafter be cleared by the respondents and the application will be decided within a period of 20 days thereafter. As stated by the counsel for the respondents, the expenses involved for getting the electricity connection restored shall be borne by the respondents. The petitioner is also directed to cooperate in getting the electricity connection restored qua the shop of the respondents. Disposed off in the above terms. Pending applications, if any, also stand disposed off.
