As per version of the complainant-Balwinder Singh, his brother Rinku Singh (since deceased) was working as a Munim at a brick kiln and petitioner used to regularly take consignments of bricks allegedly on credit at the risk of his deceased brother and for nonpayment of the amounts due, said Rinku Singh is alleged to have committed suicide leaving behind a suicide note. CRM-M 11864/2016 and even otherwise the petitioner had left the job of the brick kiln owner from where the consignment was lifted on credit. Learned State counsel on instructions does not refute the factual contentions raised by the learned counsel for the petitioner. He,further submits that suicide note is yet to be sent to Handwriting Expert.
Without commenting on the merits of the case keeping in view the above, it is directed that the petitioner shall join investigation at 10.00 am on 25.4.2016 as also as and when called for the purpose. In the event of arrest, the petitioner shall be released on bail on furnishing adequate bail and surety bonds to the satisfaction of the Arresting/Investigating Officer/Trial Court. Petitioner shall also be bound by all the conditions stipulated in Section 438(2) Cr.P.C. Disposed of in the above terms.
