M.M.S. BEDI, J. (ORAL) Petitioner has joined investigation. Recovery of 132 bottles of liquor has already been effected. Petitioner was not arrested from the spot.

State counsel, on the instructions of ASI Gursahib Singh, informs that the petitioner has already joined investigation but the application has been opposed, inter alia, on the ground that the petitioner is involved in three other cases of similar nature. Taking into consideration the totality of the circumstances, the present petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the arresting officer subject to the following conditions:

CRM-M-10870-2015 (O&M) (i) That the petitioner will join investigation as and when required;

(ii) That the petitioner will not commit the similar offence of which he is accused of during pendency of the trial; and (iii) That the petitioner will not tamper with the evidence of hamper investigation, in any manner. (M.M.S.BEDI) JUDGE September 7, 2015.
