This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 99 dated 14.03.2009 under Sections 323/324/148/149 IPC and section 326 IPC added later on at Police Station Civil Lines, Amritsar.

It appears that a similar petition was filed before Sessions Judge, Amritsar which has already been disposed of with a direction that in case petitioner appears before the Judicial Magistrate Ist Class within a week, his regular bail application shall be decided within three days.

Only apprehension of the petitioner is that he would be sent to custody during pendency of bail application. It is, thus, directed that in case petitioner surrenders before the Judicial Magistrate Ist Class within a week from today and applies for bail, his plea shall be decided within three days thereafter. However, arrest of the petitioner shall remain stayed till then. Disposed of.
