This petition has been filed under Section 482 of BNSS, 2023, seeking anticipatory bail in case FIR No.16 dated 22.01.2025 registered under Sections 331(6), 109, 324(4), 191(3), 190 of BNS, 2023 (Section 331(6) of BNS, 2023 deleted and Section 118(2), 115(2), 331(7) of BNS, 2023 added later on) at Police Station Talwandi Sabo, District Bhatinda.

On 05.03.2025, the following order was passed:- "XX XX XX XX Counsel for the petitioner inter alia submits that the petitioner is falsely implicated in the present case and otherwise also only simple injury caused with sword is attributed to the present petitioner. It is further submitted that petitioner, who is already enlarged on bail in another
two criminal cases which are being faced by him, is ready and willing to join investigation with the police, at the earliest.
The present petition is resisted by counsel for the complainant, who submits that the petitioner was member of unlawful assembly and all of them collectively caused injuries to complainant Amandeep Kaur and her husband Simarjit Singh and that the recovery of weapon used in commission of crime is still to be effected.
The State counsel while supporting the aforesaid arguments forwarded by counsel for the complainant further submits that no doubt the injury attributed to the present petitioner is found to be simple in nature but at the time of occurrence, petitioner was armed with sword and he gave blow on the head of Simarjit Singh. It is further submitted that petitioner is required by the police for the purpose of proper investigation of the case.
In view of the fact that only simple injury is attributed to the present petitioner and offence under Section 109 of BNS, 2023 is attracted against the present petitioner only with the aid of Section 190 of BNS, 2023, the petitioner is hereby directed to join investigation with the police and in case of arrest, he is directed to be released on interim bail by the IO/Arresting Officer to his own satisfaction till the next date of hearing. The petitioner is to abide by the conditions as envisaged under Section 482(2) of BNSS, 2023.

Learned State counsel assisted by learned counsel for the complainant and on instructions from ASI Gamdoor Singh, at the very
outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 4.
In view of the statement of learned State counsel, order dated 05.03.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 5.
The petition stands disposed of.
