The prayer in the present criminal writ petition under Articles 226/227 of the Constitution of India is for the issuance of a writ, order or directions especially in the nature of Habeas Corpus directing the respondent Nos.1 to 3 to release the petitioners from the illegal custody of the police as firstly, they have been arrested without the ground of arrest as provided under Article 22(1) of the Constitution of India and secondly, they have not been produced before the Court of Illaqa Magistrate, within a period of 24 hours of their arrest.

CRWP-1542-2026 -2121(1), 132, 221 of BNS and Section 25(1-B)A of Arms Act, Police Station Civil Lines, Bhiwani. The allegations were that firing had taken place at the Courts complex. Thereafter, an FIR No.21 dated 03.02.2026 was registered at the instance of complainant-Arvind at 6:00 pm, wherein 07 persons including the present petitioners were named as accused. When the police party went to arrest the accused, they were fired upon, leading to the registration of an FIR No.22 dated 03.06.2026 at 6:33 pm, under Sections 109(1), 121(1), 132, 221 of BNS and Section 25(1-B)A of Arms Act, Police Station Civil Lines, Bhiwani. In this occurrence, Jitender and Shri Pal (present petitioners) were injured. Both were admitted to the Civil Hospital, Bhiwani. Subsequent to their discharge on 08.02.2026, they have been arrested in FIR No.22 dated 03.06.2026 at 6:33 pm, under Sections 109(1), 121(1), 132, 221 of BNS and Section 25(1-B)A of Arms Act, Police Station Civil Lines, Bhiwani.

In view of the above-mentioned admitted facts, no orders are required to be passed in the instant case, which pertains to FIR No.21 only.
