NARESH KUMAR SANGHI, J. (Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Joga Ram, son of Deraj, resident of Heeran Di Tahni, Police Station, Girra, District Badmer (Rajasthan), who has been booked for having committed the offence punishable under Section 18 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity, 'the NDPS Act'), in a case arising out of FIR No. 46, dated 14.6.2013, registered at Police Station, Kheri Gandian, District Patiala. The case was called twice, but no one has proposed to appear for the petitioner.

Learned counsel for the State on instructions from ASI Sukhdev Singh of Police Station, Kheri Gandian, District Patiala, submits that the prosecution has already led its entire evidence and the case before learned Trial Court is now fixed for leading the defence evidence. CRM-M-1092-2015 five kilograms Opium of commercial quantity was recovered from the petitioner and, as such, he is not entitled to bail as per Section 37 of the NDPS Act.
