R.P. Nagrath, J. (Oral) Prayer made in the instant petition is under Section 482 Cr.P.C. for issuance of direction to respondents no. 1 to 3 to take appropriate departmental action against respondent no. 4 for illegally raiding the house of the petitioner. Prayer is also made for issuance of direction to respondents no. 1 to 3 to protect life and liberty of the petitioner at the hands of respondents no. 4 and 5. Learned State counsel has filed the affidavit of Harinder Pal Singh, Deputy Superintendent of Police, District Ludhiana (Rural) and the same be taken on record.

Learned State counsel submits that as per reply, the petitioner was never called to the police station and there is no FIR registered against him. It is further submitted that motorcycle of the petitioner was not taken into possession by the police but learned counsel for the petitioner submits that about 30 persons including members of panchayat have given a writing to the effect that JITENDER KUMAR 2015.07.03 16:41 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-10921 of 2015 -2motorcycle of the petitioner was taken by the police. In view of the above stand on behalf of the State, no further indulgence of this Court is required and the instant petition is disposed of as such.

With regard to taking into possession the motorcycle, respondent no. 3-Senior Superintendent of Police is directed to depute an officer not less than the rank of Superintendent of Police to hold an enquiry into this aspect and if warranted, take appropriate action in accordance with law.
