Complainant-Ganesh Chander alleges that non-applicant co-accused Amarjit Singh had received a total sum of Rs.50 lacs from different persons for sending them to America on permanent basis. It is contended that false case has been foisted upon petitioner only because she is mother of said non-applicant co-accused Amarjit Singh. Her name has surfaced only in an enquiry and that too with the role of accompanying Amarjit Singh while receiving payment. CRM-M 10935/2015 submits that petitioner is yet to join investigation and challan is yet to be presented. He further submits that main accused was arrested and has since been enlarged on regular bail. It is also submitted that nothing is to be recovered from the petitioner.
In view of the above,petition is allowed and it is ordered that in the event of arrest, the petitioner shall be released on bail on furnishing adequate bail and surety bonds to the satisfaction of the Arresting/Investigating Officer/Trial Court.
