Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.5 dated 14.01.2009 under Sections 379 and 411 IPC, registered at Police Station Sadar Sri Muktsar Sahib, District Sri Muktsar Sahib, as petitioner absented from learned trial Court and his bail and surety bonds were cancelled and non-bailable warrants were issued.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the main allegation against the VINEET GULATI 2016.07.23 15:10 I attest to the accuracy and authenticity of this document Chandigarh petitioner is that he had stolen machine on 07.01.2009. Learned counsel for

CRM No.M-11932 of 2016 -2the petitioner contended that the petitioner while in custody in another case, absented from the proceedings of this case w.e.f. 20.08.2014. Learned counsel for the petitioner further contended that the petitioner has appeared before the trial Court and he has already been released on interim bail. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of grant of anticipatory bail. Therefore, the present petition is accepted and the order dated 06.04.2016 granting interim bail to the petitioner is made absolute.
