***** ARCHANA PURI, J. (Oral) CM-14549-CII-2023 The present application has been filed at the behest of applicantrespondent No.1, for early hearing of the main petition i.e. CR-996-2022. It is submitted by learned counsel for the non-applicants/petitioners that vide order dated 15.05.2023, a prayer was made for deletion of the names of petitioners (defendants No.5 to 12, 21 to 27, 29 to 35, 37, 38, 40 and 41), who had filed the application under Order 7 Rule 11 CPC, which was dismissed vide the impugned order.

It is further submitted that needful was done before learned Lower Court. However, the case is not making further progress, on account of present revision petition still to be pending.

CM-14549-CII-2023 IN/AND CR-996-2022 -2In view of the submission, so made and also with regard to the deletion of the names of the defendants aforesaid, by whom the application under Order 7 Rule 11 CPC was filed, which was dismissed vide the impugned order, has already been deleted, from the array of parties vide order dated 22.05.2023, passed by learned Lower Court, copy whereof has been placed on record. The instant application is allowed and the main revision petition i.e. CR-996-2022, is taken up for hearing today itself. CR-996-2022 In view of the submissions aforesaid, learned counsel for the petitioners submits that he does not want to pursue with the present revision petition and seeks permission of the court to withdraw the same. Ordered accordingly.
