NIDHI GUPTA J. (Oral) The present revision petition has been filed against the order dated 25.1.2023 passed by learned Additional District & Sessions Judge, as Principal Judge, Family Court, Jind, whereby the petitioner is awarded imprisonment from 25.1.2023 to 21.4.2023 due to non-payment of maintenance allowance to wife under Section 125 Cr.P.C.

Vide order dated 01.3.2023 passed by co-ordinate Bench of this Court, operation of the impugned order dated 25.1.2023 was stayed subject to deposit of 50% of the amount as mentioned in the impugned order. Learned counsel for the petitioner submits that the petitioner was unable to arrange the said amount and in the meantime, the petitioner has undergone the awarded sentence from 25.1.2023 to 21.4.2023 i.e. about three months.
