*** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.114 dated 12.07.2014, under Sections 353, 186, 323, 427 and 34 IPC, Police Station City Batala, District Gurdaspur and all subsequent proceedings arising therefrom, on the basis of compromise (P-3).
Pursuant to orders dated 18.01.2016, 23.05.2017, 14.03.2018, 14.05.2018 and 30.08.2018 of this Court, the parties appeared before the trial Court on 20.09.2018 for recording their statements. Learned SubDivisional Judicial Magistrate, Batala, has submitted her report vide letter bearing No.1412 dated 06.10.2018 duly forwarded by learned District and Sessions Judge, Gurdaspur, vide Endst. No.19936/RKT dated 08.10.2018. According to the report, ld. Sub-Divisional Judicial Magistrate, SONIKA 2019.03.18 18:27 I attest to the accuracy and authenticity of this document Chandigarh Batala is satisfied that compromise effected between the parties is
CRM-M-10964 of 2015 --2-- genuine, which is not the result of any pressure or coercion. No accused has been declared proclaimed offender.
In compliance of order dated 23.01.2019, receipts regarding deposit of costs of `15,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of ld. Sub-Divisional Judicial Magistrate, Batala dated 06.10.2018 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.114 dated 12.07.2014 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only.
Disposed of accordingly.
