Dated Police Station Sections 06.05.2023 Barara, District 148, 149, 323, 324, 326, 452, Ambala 307 & 506 IPC (offence under Sections 420, 467, 468, 471 & 506 IPC added later on) 1.
The petitioner incarcerated in the FIR captioned above, has come up before this Court under Section 483 BNSS 2023 seeking regular bail. 2.
Counsel for the State strenuously opposed the bail on the grounds that there is no change in circumstances after rejection of earlier petition. 3.
After arguing for considerable time, when this Court was not inclined to grant bail, counsel for the petitioner submits that he be permitted to withdraw the present petition and prayed for direction to the trial Court to decide the case expeditiously. 4.
Generally, this Court refrains from passing such direction but considering the petitioner's custody, it is a special case where this court is requesting the concerned trial court to make all endeavours to expedite the trial and decide the case on priority. CRM-M-8370-2025 clarified that this order speeding up the trial is subject to the condition that neither the petitioner shall seek any adjournment nor try to use any tactics to delay the trial. If he does so, this order of expediting the trial shall stand automatically recalled by resorting to Section 403 read with 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], without any further reference to this court. If any of the accused is on bail and fail(s) to attend the trial without any sufficient cause, then they be dealt with strictly but in accordance with law.
Petition disposed of as withdrawn in aforesaid terms. All pending applications, if any, stand disposed.
