Prayer made in the present petition for quashing the appointment of respondent No.3 made vide order dated 03.11.2000 as Kanungo, might not, due to efflux of time, even be surviving. 2.

Learned State counsel refers to the preliminary objection of the written statement dated 21.03.2001 filed on behalf of respondent No.1 to state that respondent No.3, who was working as Kanungo, was transferred on his request to District Nawanshahr, where he was earlier working, subject to the condition that he will not claim any seniority, in compliance to which he was assigned the duties as Kanungo, while the petitioner was working as Patwari in the said district.

Learned counsel also submits that he has been unable to establish contact with the petitioner.
