Mr. Sanjay Vashisth, Advocate, for the petitioner. Mr. Vikas Chopra, DAG, Haryana, for the respondent. *** Amol Rattan Singh, J. (ORAL) Pursuant to the order dated 05.04.2017, the affidavit of Sh. Sunil Kumar, IPS, Superintendent of Police, Charkhi Dadri, has been filed in Court today by the learned State counsel, in which it is stated that in view of the contradictory version of the arrest of the petitioner given by ASI Devender Singh, a departmental inquiry has been initiated against the said official.

In view of the aforesaid, since there is obviously a contradiction even in the manner in which the petitioner was arrested, the whole recovery itself, prima facie at least, becomes doubtful, subject of course to what eventually the findings of the learned trial Court are, as per the evidence before it. Therefore, I consider it appropriate to make the order dated 05.04.2017, granting interim bail to the petitioner, absolute on the same terms and conditions.

The petition is disposed of accordingly.
