The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondent No. 3 to re-issue him passport.

The petitioner was issued passport on 26.07.1999 which expired on 25.07.2009. The petitioner again acquired passport dated 26.03.2013 which was valid upto 25.03.2023. The petitioner vide application dated 26.10.2023 applied for re-issuance of passport. The respondents have put the matter on hold.

Mt. K.K.Thakur, Advocate submits that no criminal case is pending against the petitioner, thus, respondents have no authority to withhold re-issuance of passport.

Notice of motion.

Mr. Amit Sharma, Senior Panel Counsel for Ms. Monica Chawla, Central Government Counsel for Union of India, who on advance notice is present in Court, accepts notice and waives service. 6.

Mr. Amit Sharma submits that passport authority wants to ascertain whether petitioner, on the earlier occasion, had travelled abroad and whether he had ever used Emergency Certificate. For the said purpose, he may be directed to appear before passport authority alongwith affidavit disclosing the requisite information.

Mr. K.K.Thakur asserts that petitioner would appear before passport authority on 18.03.2024 alongwith affidavit disclosing his status of travelling abroad as well as using Emergency Certificate. 8.

In the wake of statement of both sides, the petition stands disposed of. The passport authority shall endeavour to dispose of application of the petitioner expeditiously.
