**** HARI PAL VERMA, J. (ORAL) Prayer in the present petition filed under Section 482 of the Code of Criminal Procedure, 1973 is to quash the order dated 16.1.2017 (Annexure P-1) passed by the Judicial Magistrate Ist Class, Ambala in case complaint No. 1610 dated 23.9.2015 under Section 138/142 of the Negotiable Instruments Act and Section 420 IPC whereby the petitioner was declared a proclaimed person.
Mr. Vikrant Pamboo, Advocate has put in appearance on behalf of respondent No. 2 and filed power of attorney on his behalf. Same is taken on record.
On 25.4.2017, this Court has passed the interim order in the same terms as in CRM-M-11220 of 2017 wherein this Court has ordered that in the event of appearance of the petitioner before the trial Court, within a week, the trial Court shall admit the petitioner on interim bail in FIR under Gurpreet Singh Bhatia 2017.09.01 16:57 I attest to the accuracy and authenticity of this document Chandigarh Section 174-A IPC.
CRM-M-11153 of 2017 (O&M) -2Learned counsel for the petitioner states that pursuant to the aforesaid order, the petitioner has surrendered before the trial Court and she has been admitted on bail.
In view of the fact that the petitioner has surrendered before the trial Court, the present petition is rendered infructuous and is disposed of accordingly.
However, since the petitioner has not sought the quashing of the FIR registered under Section 174-A IPC, she is at liberty to avail the remedy as available under law.
