******* SURINDER GUPTA, J.(Oral) Present petitions have been filed under Section 439 Code of Criminal Procedure for grant of regular bail to petitioners in case FIR No. 223 dated 30.11.2016 registered for offences punishable under Sections 399, 402 of Indian Penal Code (for short, "IPC") at Police Station Division No. 8 Jalandhar, District Jalandhar.
Heard.
As per case of prosecution, instant FIR was registered on the basis of secret information that petitioner-Ravi Hans in CRM-M-111732017 alongwith petitioner-Rahul Kumar @ Sonu Takk in CRM-M-143212017 alongwith Haider Ali and Karan Kumar have formed a criminal gang Jitender Kumar 2017.05.05 14:48 I attest to the accuracy and integrity of this document CHANDIGARH
CRM-M-11173 of 2017 -2and were planning to commit dacoity. Police arrested petitioner-Rahul Kumar @ Sonu Takk, Haider Ali and Karan from the spot but petitionerRavi was arrested in this case on 23.12.2016. It is submitted that after investigation the police has presented challan against petitioners in Court.
In view of above but without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, present petitions are allowed. Petitioner-Ravi Hans in CRM-M-11173-2017 and petitioner-Rahul Kumar @ Sonu Takk in CRM-M-14321-2017 are ordered to be released on regular bail on furnishing bail bonds and surety bonds to the satisfaction of concerned trial Court/Chief Judicial Magistrate/Duty Magistrate, subject to following terms:- (a) petitioners shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
(b) In the event of their absence on any date of hearing, the benefit of bail allowed to petitioners shall stand withdrawn. The trial Court shall be competent to cancel their bail bond and surety bond and proceed to procure their presence in accordance with law. In that eventuality petitioners shall have to apply for bail afresh. (c) They shall not leave the country without the previous permission of the Court.
