Mr. Arjun Lakhanpal, Advocate, for the petitioner. RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 438 Cr.P.C. prayer has been made for grant of pre-arrest bail to the petitioner in case FIR NO.105 dated 10.12.2017 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Fatehgarh Panjtoor, District Moga.

According to the prosecution, on 10.12.2017, 250 grams intoxicating powder was recovered from the possession of the petitioner. Earlier the petitioner was granted interim bail by the trial Court vide order dated 28.03.2018 till receipt of FSL report, which was to be filed by the police on 04.08.2018.

On that date i.e. 04.08.2018, petitioner absented from the trial Court. Considering the FSL report and the fact that commercial quantity of contraband was effected from the petitioner, the trial court cancelled her bail bonds and surety bonds and forfeited the same to the State. Learned counsel contends that no recovery was effected from RAVINDER SINGH 2019.03.06 12:16 I attest to the accuracy and integrity of this document

Considering the heavy quantity of intoxicating powder recovered from the the petitioner, this Court is not inclined to grant anticipatory bail to her, inasmuch as, offenders like the petitioner, initially, seek anticipatory bail till receipt of FSL report. Thereafter, on receipt of FSL report, they try their level best to remain on anticipatory bail, till conclusion of trial by raising all possible frivolous pleas. This practice has to be deprecated.

Dismissed.
