Hon'ble Mr. Justice Inderjit Singh .....

Present:

This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.127 dated 24.11.2015 registered for the offences under Sections 489-A, 489-B, 489-C and 489-D IPC at Police Station Panjokhera, District Ambala.

Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Haryana appearing for the respondentState and have gone through the record. Harpal Singh Parmar 2017.04.28 16:59 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-11176 of 2017 [2] From the record, I find that this is second petition filed for regular bail. Earlier petition was dismissed on merit by this Court. As per the allegations fake currency notes of `14,60,000/- were recovered from the present petitioner.

The petitioner has been in judicial custody since 29.11.2015. It is brought to my notice that till now not even a single witness has been examined which means that the trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Keeping in view the facts and circumstances of the present case, custody period of the petitioner and the fact that there is no progress in the trial so far, therefore, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate. April 27, 2017.
