**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 78 dated 30.9.2016 registered at Police Station Goindwal Sahib, District Tarn Taran under Sections 376, 511 IPC and Section 8 of POCSO Act. Counsel for the petitioner contends that the petitioner is in custody since 30.9.2016 and the complainant has not supported the prosecution story and had turned hostile.

State counsel informs that the victim is two years old and after the receipt of the FSL report, charge has been amended and now all the witnesses will be re-examined and in the FSL report, spermatozoa was found and the medical evidence refers to redness on the vagina. Initially the FIR had been registered for attempt of rape but the medical report suggest that the child was ravished.
