CHANDIGARH.

CRM-M-11149 of 2015 Date of Decision: April 23, 2015 Jasbir Kaur ....Petitioner

Versus

State of Punjab.

.....Respondent

CORAM:

HON'BLE MR.JUSTICE RAJAN GUPTA

Present:

Mr.Vivek Suri, Advocate for the petitioner.

Mr.Shilesh Gupta, Addl.A.G.,Pb.

Rajan Gupta, J (Oral) This is a petition under Section 438 Cr.P.C seeking pre-arrest bail in a case FIR No. 29 dated 11.3.2015 registered against the petitioner under Sections 384, 385, 388 IPC at Police Station, Kotwali Nabha, District Patiala.

As per prosecution version, the case was registered on the statement of Rupinder Singh. He alleged that on 6.3.2015, Bikkar Singh met him and took him alone through jail pahi road, Nabha. They went into the room where two persons namely Jitender Singh and Monu were already present. The accused took off the clothes of the complainant forcibly. Thereafter, an objectionable movie was made to harm his reputation. He was told that if Rs.2 lacs was not paid, they would upload the movie on whatsapp. His golden ring, Rs.17,000/- and ATM card were snatched.

Counsel for the petitioner submits that petitioner has been

CRM-M-11149 of 2015 2 falsely implicated. She has no role to play in the crime. Thus, concession of pre-arrest bail be granted.

Plea has been opposed by learned State counsel. According to him, during investigation CD has been recovered wherein involvement of the petitioner is clear.

I have heard learned counsel for the parties. Keeping in view the serious nature of allegations, I am of the considered view that petitioner is not entitled to discretionary relief of prearrest bail. Her custodial interrogation is necessary to take the investigation to its logical end.

Dismissed.
