(Oral) The grievance of the petitioner in this writ petition is that on account of an attachment order dt.1.2.2019 issued by the Income Tax Department, sale in its favour was not getting finalized, even though final transfer letter has been issued.

Mr. Tajender K. Joshi, Advocate has placed before us an E.mail dt.16.3.2022 issued to him by Income Tax Department proposing to withdraw the attachment notice issued by TRO Gurugram vide F.No. TRO/GGN/18-19/6732-36 dt.1.2.2019. The said E.mail is taken on record. The second respondent shall within four weeks withdraw the attachment issued on 1.2.2019 in view of the statement made in E.mail PARVINDER SINGH 2022.08.31 14:30 I attest to the accuracy and authenticity of this document

CWP No. 5535 of 2021 dt.16.3.2022 issued by the TRO Faridabad to Mr. Tajender K. Joshi, Advocate for the Income Tax Department.

We also clarify that clause 13 of the proceedings dt.11.12.2020 issued by the first respondent, is no longer operative having regard to the withdrawal of the attachment by the TRO Faridabad. With these observations, the Writ Petition is disposed of. The FDR for `18,94,110/- deposited by the petitioner before the Registrar of this Court shall be returned to the petitioner.

All pending miscellaneous applications shall also stands disposed of.
