***** ARUN MONGA, J. (ORAL) Having suffered concurrent adverse findings by the two Courts below, defendant No.1 is in second appeal before this Court assailing Ld. Trial Court judgment and decree dated 31.08.2015, as upheld by Ld. First Appellate Court vide its judgment and decree dated 15.11.2018, allowing preliminary decree of partition in favour of plaintiffs/respondents No.1 & 2. 2.

When the matter was taken up on 17.11.2022, none appeared for the appellant. Same is the position even today. It seems that either the appeal before this Court is rendered infructuous or otherwise the appellant is not interested to pursue the same.

Be that as it may, dismissed in default.
