NARESH KUMAR SANGHI, J. (Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Inderjeet, son of Harmail Singh, resident of Village Ghaswan, Tehsil Ratia, District Fatehabad, who has been booked for having committed the offences punishable under Sections 120-B, 409 and 420, IPC; Section 3(7) of the Essential Commodities Act; and Section 13(i)(c) of the Prevention of Corruption Act, in a case arising out of FIR No. 369, dated 10.12.2014, registered at Police Station, Bhattu Kalan, District Fatehabad.
Learned counsel contends that the petitioner is a farmer; as per the prosecution case, he (petitioner) had illegally PRASHANT KAPOOR 2015.01.12 18:09 I attest to the accuracy and authenticity of this document
CRM-M-112-2015 procured 100 bags of Urea for his fields; the provisions of Section 13 of the Prevention of Corruption Act as well as Section 409, IPC, are not attracted qua the petitioner; the petitioner is behind the bars from 12.12.2014; and that qua the petitioner investigation is complete and he is languishing in the jail.
Learned counsel for the State very fairly concedes that the petitioner is a farmer and he is neither required nor involved in any other case.
After hearing learned counsel for the parties and going through the material available on record, this Court is of the considered opinion that the petitioner deserves the concession of bail in this case at this juncture and, as such, the present petition is allowed. The petitioner, Inderjeet, son of Harmail Singh, resident of Village Ghaswan, Tehsil Ratia, District Fatehabad, is ordered to be released on bail during pendency of the investigation and trial of the present case subject to his furnishing bail bond to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Fatehabad.
