The petitioner has been in custody w.e.f. 20.4.2013 for having been found in possession of commercial quantity of Methamphetmine. In view of the commercial quantity, in ordinary course, the petitioner is not entitled to be released on bail but as per the report of the medical report of the Medical Officer, Central Jail, Jalandhar, the petitioner is suffering from HIV+, addict to IVDU heroin for the previous three months, showing symptoms of respiratory distress and ibscess in inguinal area. In view of the above, the petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to the condition that the petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial. In case of his doing so, this order will be deemed to have been cancelled automatically.
