RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Parveen - in a case arising from FIR No.699 dated 16.09.2018 registered under Sections 302, 120-B, 201, 34 IPC at Police Station Bhiwani Sadar, District Bhiwani. According to prosecution, wife of deceased Mukesh, namely, Kavita had illicit relations with co-accused of the petitioner, namely, Chetan. When deceased Mukesh objected to it, his wife hatching a conspiracy with her paramour Chetan with the help of petitioner, got murdered her husband Mukesh.
Learned counsel inter alia contends that petitioner has falsely been implicated on the basis of disclosure statement of co-accused Chetan, which is a very weak type of evidence. It is a case of blind murder. There is no direct evidence against the petitioner. -2CRM-M-7861 of 2020 29.10.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Parveen - is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
