As per the office report, notice issued to the respondent has been received back served through his father, however, he has chosen not to enter appearance.
Smt. Rani-the applicant (the wife of the respondent), prays for transfer of the petition (Dharambir vs. Rani) filed under Section 13 of the Hindu Marriage Act, 1955, pending in the Family Court, Rohtak, to the Court of competent jurisdiction at Karnal.
The learned counsel representing the petitioner contends that respondent in the petition under Section 13 of the Hindu Marriage Act, 1955, has alleged that the petitioner has lost her mental balance. It is apparent from reading of para 8 of the petition under Section 13 that the respondent (Husband) is taking care of three young daughters born out of the wedlock of the petitioner and respondent. TA-279-2021 (O&M) facilities between Rohtak and Karnal are excellent. In view of the aforesaid facts, no ground to transfer the petition is made out.
