******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 52 dated 05.05.2015 registered for the offences punishable under Sections 353, 186, 506, 201 read with Section 34 of Indian Penal Code (IPC) and 135 of Electricity Act, at Police Station Mamdot, District Forozepur.

Heard.

Learned State counsel on instructions from ASI Sukhdev Singh submits that during investigation the petitioner was found innocent and was kept in column no. 2. During trial, the trial Court summoned the petitioner. Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and vide order dated 27.03.2018, he has been allowed interim bail on furnishing bail bonds and surety bonds in a sum of `25,000/-.

CRM-M-12186 of 2018 -2challan has already been presented, custodial interrogation of the petitioner is no more required, order dated 23.03.2018 is made absolute subject to following terms:- (a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh. (c) He shall not leave the country without the previous permission of the Court.
