IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CRM-M-11327 of 2017 Date of Decision: 17.04.2017 Lakhwinder

...Petitioner

VERSUS

State of Haryana

...Respondent

CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. S.S. Antal, Advocate for the petitioner.

Ms. Neelam Kashyap, DAG, Haryana.

******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that after dismissal of earlier bail application on 30.01.2017, no witness has been examined by the prosecution so far. On this ground he seeks regular bail for the petitioner.

Learned State counsel submits that out of total 20 witnesses 8 have already been examined and the next date is fixed as 08.05.2017. Earlier bail application of the petitioner was declined vide order dated 30.01.2017. I do not find any reason to extend the benefit of regular bail to the petitioner merely because during the period of about 2 1⁄2 months after dismissal of earlier bail application, the prosecution has not been able to examine any witness, as such, the instant petition is dismissed. Trial Court is directed to expedite the trial of the case and dispose of the same at the earliest preferably within a period of six months of receipt of copy of this order.
