(Oral) The petition has been filed inter alia seeking a writ of mandamus directing the respondents to release death-cum-retirement gratuity to the petitioner for the service rendered by him from 31.08.1968 to 30.04.1998. 2.

Learned State counsel, however, points out that the petitioner has never been in Government service, and the claim against the respondents is not maintainable. As per his own averments, during the aforesaid period of service he worked in Rasthriya High School, Rewari, and Saini High School, Rewari, which are not parties to the petition.

Learned counsel for the petitioner is not in a position to dispute the facts aforementioned.

In view thereof, the petitioner's claim is not maintainable, and the petition stands dismissed.
