Jaswant Singh,J(Oral) Prayer is for grant of anticipatory bail on behalf of accused brothers-Satnam Singh and Sona Singh @ Avtar Singh in case FIR No.126 dated 22.11.2014 under Sections 21, 22,27, 29, 61,85 of the Narcotic Drugs and Psychotropic Substances Act,1985 and 25/54/59 of the Arms Act,PS Rajasansi, Distt.Amritsar.
The allegations against the petitioners are that a secret information was received that the accused petitioners alongwith two other co-accused were involved in the business of smack and heroin and also in possession of illegal arms.
It was contended that except the allegations of a raid conducted on secret information no overt act is shown to have been conducted by the police party. Petitioners are sought to be arrested RAJINDER PRASHAD JOSHI 2016.05.23 16:17 I attest to the accuracy and integrity of this document
CRM-M 12303/2016 only on the basis of aforesaid allegations and there is no recovery effected from the petitioners.
Vide order dated 11.4.2016 while granting interim protection, petitioners were directed to join investigation. At the time of hearing today,learned counsel for the petitioners submits that pursuant to the order dated 11.4.2016, petitioners have joined investigation and fully cooperated. Learned State counsel on instructions submits that petitioners have joined investigation and their custodial interrogation is no longer required.
In view of the above, interim bail granted vide order dated 11.4.2016 is made absolute.
