In the present writ petition, the grievance being raised is that petitioner No.1 who is an orphan and is 70% disabled, is not being granted the benefit of financial assistance/compassionate appointment as per the instructions of the Government.

Learned counsel for the petitioners submits that father of the petitioner No.1 had died on 17.09.1995 after which, the petitioner No.1 and her mother i.e. petitioner No.2 became entitled for certain benefits, which were not extended to her.

Learned counsel for the petitioners submits that the petitioners have already raised the claim for compassionate appointment by filing a representation dated 02.12.2022 (Annexure P-11) but the same is not being given to the petitioners and therefore, appropriate direction needs to be issued to the respondents to grant the benefit of compassionate appointment to petitioner No.1 after the death of her father as envisaged under the policy which was applicable at the time of the death of father of the petitioner HARSHA RANI 2024.03.06 17:24 I attest to the accuracy and integrity of this document

Learned counsel for the petitioners further submits that the claim of the petitioners is covered by the settled principle of law settled by the Division Bench of this Court in CWP No.13465 of 2005 titled as Kumari Bandana Sharma vs. State of Haryana and others, decided on 01.05.2006 as well as by the Coordinate Bench of this Court in CWP No.19459 of 2009 titled as Sonu vs. State of Haryana and others, decided on 12.12.2016 (Annexure P-15) and in CWP No.19754 of 2019 titled as Bhagesh @ Varsha and another vs. State of Haryana and others, decided on 21.11.2013 (Annexure P-13).

Mr. Harish Nain, learned Assistant Advocate General, Haryana, who is present in the Court, accepts notice on behalf of the respondents. 7.
Learned counsel for the respondents submits that in case the representation of the petitioners dated 02.12.2022 (Annexure P-11) has been received in the concerned office and the same is still pending consideration with the authorities concerned, the same will be decided by the authorities concerned within a period of eight weeks from the receipt of copy of this order and the settled principle of law being claimed in favour of the petitioners will also be kept in mind while passing the speaking order. 8.
Learned counsel for the petitioners submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further. 9.
